The smallest bandwidth at which the estimate has at most this many modes.

Well defined only because the kernel is Gaussian: Silverman (1981) proves the mode count is then non-increasing in the bandwidth, so the set of bandwidths satisfying the hypothesis is an interval unbounded above and bisection finds its lower end. With any other kernel this function would return an arbitrary member of a disconnected set.
